Welcome to Martina V. Creative. These Terms & Conditions govern your use of this website and your purchase of artwork and creative services through Martina V. Creative.

By accessing or using this website, purchasing artwork, or engaging Martina V. Creative for a commission, you agree to these Terms & Conditions and any additional terms that apply to the specific product or service you purchase.

If you do not agree with these terms, please do not use the website or purchase products or services through it.

1. ABOUT MARTINA V. CREATIVE

Martina V. Creative is an independent art and creative business operated by Martina Vigini in Ontario, Canada.

Services and products may include:

Original paintings and artwork
Custom commissioned artwork
Indoor murals
Outdoor murals
Painted furniture and décor
Custom creative projects
Artwork sold through the online shop

2. ARTWORK

All artwork displayed on this website is created by Martina V. Creative unless otherwise stated.

Because artwork is handmade:

Colours may vary slightly from photographs displayed online.
Minor variations in texture, brushwork, colour, and finish are normal.
Dimensions may have minor variations where applicable.
Screen settings can affect how colours appear.

These variations are characteristics of original artwork and are not considered defects.

3. ARTWORK OWNERSHIP AND COPYRIGHT

Unless expressly stated otherwise, all artwork, photographs, designs, illustrations, concepts, written content, logos, branding, and other creative materials displayed on this website remain the intellectual property of Martina V. Creative.

Purchasing an original artwork gives the purchaser physical ownership of that particular artwork.

It does not transfer copyright or other intellectual property rights.

Unless otherwise agreed in writing, you may not:

Reproduce the artwork commercially
Create prints or reproductions
Copy or substantially recreate the artwork
Use the artwork as a logo or trademark
Sell reproductions
Digitally reproduce the artwork for commercial purposes

Martina V. Creative retains the right to photograph and reproduce images of completed artwork for portfolio, promotional, editorial, website, and social media purposes, subject to any separate written agreement with the client.

4. ONLINE SHOP

Artwork displayed in the online shop is subject to availability.

Adding an item to your shopping cart does not guarantee that the artwork will remain available.

An order is considered accepted once payment has been successfully processed and an order confirmation has been issued, subject to any rights or cancellation provisions required by applicable law.

I reserve the right to correct pricing, description, inventory, or technical errors.

If an error results in an incorrect price being displayed, I may contact you before fulfilling the order.

5. PRICES AND TAXES

All prices will be displayed in the currency indicated on the website.

Applicable sales taxes, shipping charges, customs charges, duties, and other fees will be identified at checkout where applicable.

For international orders, the purchaser may be responsible for customs duties, import taxes, brokerage fees, or other charges imposed by the destination country.

6. PAYMENTS

Payments may be processed through Wix and third-party payment processors.

By submitting an order, you confirm that you have authorization to use the selected payment method.

Martina V. Creative does not intentionally store complete credit card information.

7. COMMISSIONS

Custom commissions are governed by a separate Commission Terms agreement.

A commission does not begin simply because an inquiry, idea, or consultation has been submitted.

A commission becomes an active project only after the client has accepted the proposal/agreement and completed any required deposit or initial payment.

The Commission Terms will establish the specific scope, pricing, payment schedule, timeline, revisions, approvals, ownership, and other project-specific terms.

8. MURALS

Mural projects are individually quoted because pricing depends on factors including:

Wall dimensions
Surface condition
Indoor or outdoor location
Accessibility
Design complexity
Detail level
Materials
Surface preparation
Travel
Equipment requirements
Project timeline

A mural quote is based on the scope described in the proposal.

Additional work or changes requested after approval may result in additional charges.

9. WEBSITE CONTENT

I make reasonable efforts to ensure website information is accurate and current.

However, errors, omissions, technical issues, colour variations, and changes in availability may occur.

I reserve the right to update website content, pricing, artwork availability, services, and policies without notice.

10. THIRD-PARTY LINKS AND SERVICES

This website may contain links to third-party websites or services.

I am not responsible for the content, availability, security, or privacy practices of third-party websites.

Your use of third-party services may be subject to their own terms and policies.

11. LIMITATION OF LIABILITY

To the extent permitted by applicable law, Martina V. Creative will not be responsible for indirect, incidental, special, or consequential losses arising from the use of this website or products purchased through it.

Nothing in these Terms & Conditions is intended to exclude or limit any consumer rights that cannot legally be excluded or limited under applicable law.

I may update these Terms & Conditions from time to time.

The updated version will be posted on this website with the revised Last Updated date.

These Terms & Conditions are governed by the laws of the Province of Ontario and the applicable laws of Canada.
